A federal appeals court has upheld a state Medicaid reimbursement for a woman's prescription for Viagra, the drug she was prescribed for and the prescription she had paid for.
The lawsuit, filed in Manhattan Circuit Court, alleges that in a settlement with the plaintiffs that included a "substantial portion of the medical expenses associated with her treatment, the plaintiffs failed to properly and accurately describe the various costs incurred during their treatment and failed to adequately warn them of the potential negative effects of the drug."
In a lawsuit filed in the Eastern District of New York, plaintiffs claim that they suffered emotional and physical harm as a result of the plaintiffs' failure to adequately warn them of the negative effects of Viagra.
According to the complaint, which was filed in the Eastern District of New York, plaintiffs "alleged that defendants intentionally omitted important information about the effects of Viagra on the plaintiff's sexual interest and performance," adding that "the defendants' failure to disclose these important information caused the plaintiffs further harm."
The complaint also alleges that, "plaintiffs allege that Defendants' actions and/or acts of omission and omission at the time of the Defendants' failure to disclose information about the adverse effects of Viagra led to their inability to properly and accurately advise the plaintiffs of the potential negative consequences of their treatment," and also alleged that "plaintiffs allege that Defendants knew or should have known that these important information and warnings caused their adverse health effects."
Plaintiffs argue that the complaint and allegations are meritless.
"This is not a case that was properly investigated and presented to the Court of Appeals," said John L. Shekmati, a partner at Shekmati & Associates LLP. "The plaintiff was diagnosed with chronic obstructive pulmonary disease (COPD) and prescribed a prescription for Viagra, which he used to treat his COPD symptoms. Plaintiffs allege that Defendants knew or should have known that these adverse effects occurred and failed to properly and accurately warn the plaintiffs of the potential negative effects."

The lawsuit further alleges that, "plaintiffs allege that Defendants' actions and/or acts of omission and omission at the time of the Defendants' failure to adequately warn the plaintiff of the adverse effects of Viagra caused his sexual problems," and also alleged that "plaintiffs allege that Defendants knew or should have known that these adverse effects, including sexual dysfunction, caused plaintiffs' sexual symptoms."
The plaintiffs, who are from Massachusetts, New York, and Connecticut, represent about 100,000 people nationwide, including in the state of New Jersey. The plaintiffs have sued more than 1 million other individuals.
